NCAA Men’s Basketball Pool Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. ENTERING INTO A DESIGN AGREEMENT WITH GONTRAM ARCHITECTURE, INC. WILL NOT IMPROVE YOUR CHANCES OF WINNING, BUT IT COULDN’T HURT.

ELIGIBILITY
This pool is offered to legal residents of the United States at least 18 years old as of the date of entry. Void where prohibited by law. Employees of Gontram Architecture, Inc. (“Sponsor”) and the immediate family (spouse, mother, father, sister, brother, daughter, or son, regardless of where they live) or members of their same households (whether related or not) of such employees are eligible to play and may win trophies, but are not eligible to win other prizes. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects.

ENTRY
All entries must be received by 11:00 a.m. ET on the date of the initial tournament game (not including the initial “play-in” games) as advertised on this web site. No purchase necessary to enter or win. A purchase will not improve your chances of winning. You have three methods of entering:

To enter on-line, fill out a Pool Bracket Entry Form on Sponsor’s Web site at www.gontramarchitecture.com. You will be asked to provide your full name, telephone number (including area code), Hometown and e-mail address. Nicknames or aliases will cause your entry to be rejected.

Entry also permitted by mail or fax. To enter by mail or fax, obtain an empty bracket and fill it out completely. Underneath the picked champion, indicate the total number of points you predict will be scored in the championship game. Include your full name, complete home address, including zip code, home telephone number (including area code), and e-mail address. Fax to Gontram Architecture, Inc. at (919) 876-5978 by the deadline indicated above. By mail, express or UPS, send to Gontram Architecture, Inc., 220 Horizon Dr., Ste 221, Raleigh, NC 27615. All U.S. mail-in entries must be received by the date of the initial tournament game (not including the initial play-in game on Tuesday evening).

LIMIT ONE ENTRY PER PERSON, REGARDLESS OF MEANS OF ENTRY. Multiple entries will be disqualified.

No responsibility is assumed by Sponsor for lost, late, misdirected, illegible, mutilated, or postage-due entries or for any human, computer, on-line, telephone, or technical malfunctions that may occur. All entries become the property of Sponsor and will not be returned to participant.

RULES
Seed-Weighted Scoring: Winners will be selected on the basis of their picks. For each correct pick in round 1, the entrant shall receive 1 point, multiplied by the seed number. For each correct pick in round 2, the entrant shall receive 2 points, multiplied by the seed number. For each correct pick in round 3, the entrant shall receive 3 points, multiplied by the seed number. For each correct pick in round 4, the entrant shall receive 4 points, multiplied by the seed number. For each correct pick in round 5 (the Final Four), the entrant shall receive 5 points, multiplied by the seed number. For each correct pick in round 6 (the Championship), the entrant shall receive 6 points, multiplied by the seed number. If a play-in game exists, that game will not count toward this pool. The two teams affected will be represented in the initial round of the standard 64-team tournament as effectively one single team. Contestants will not need to pick a winner of the play-in game.

In the event of a tie at the completion of Round 6, the winner shall be determined by the entrant who predicted the total number of points in the Championship Game, or came closest to the total.

If there remains a tie, the winner shall be determined by the entrant who picked the most teams in the Final Four.

If there remains a tie, the winner shall be determined by the entrant who has the highest pick percentage throughout the tournament.

The winners of the pool will be notified by e-mail or telephone within approximately seven [7] days of the Championship Game. If prize is not claimed within thirty [30] days, the prize is forfeited and will not be awarded.

PRIZE & ODDS OF WINNING
Prizes are as indicated on Tournament Information page. Prizes are subject to change without notice.

Odds of winning are directly related to the number of entries and the contestant’s ability to pick the correct teams.

GENERAL CONDITIONS
The Pool is governed by, and these rules will be construed and interpreted pursuant to, the laws of North Carolina. A determined winner may be disqualified and, in such case, an alternate winner may or may not be selected from among the remaining eligible entries if a selected winner (i) cannot be reached because the prize notification or prize is returned as non-deliverable or unclaimed after 30 days, or (ii) is found to not have complied with the contest rules. All unclaimed prizes will not be awarded. By accepting the prize, where permitted by law, each winner agrees to grant to Sponsor and its licensees, affiliates, and assigns the right to print, publish, broadcast, and use–worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web–at any time or times, the winner’s name, portrait, picture, voice, likeness, and biographical information as news or information and for advertising and promotional purposes without additional consideration. Further, by accepting the prize, each winner agrees, and by entering this Pool, participants agree, to release and hold harmless Sponsor, its licensees, and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, directors, officers, employees, representatives, and agents from any and all liability for any injuries, loss, or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use, or misuse of a prize, participation in any pool-related activity, or participation in this Pool. Void where prohibited.

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Pool or Web site; to be in violation of the Terms of Usage of the Web site; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Any use of robotic, automatic, programmed, or like entry methods will void all such entries by such methods.

CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DAMAGE DELIBERATELY ANY WEB SITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE POOL IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the Pool at the actual time of entry will be deemed to be the participant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses or domain names associated with the submitted e-mail address. Sponsor will prosecute any fraudulent activities to the full extent of the law.

LIMITATIONS OF LIABILITY
Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or utilized in the Pool or by any technical or human error that may occur in the processing of submissions in the Pool. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, or destruction or unauthorized access to the Web site. Sponsor is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Pool or downloading materials from or use of the Web site. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Pool, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Internet portion of this Pool for any entries and select the winner from regular mail-in entries and Internet entries received for that drawing prior to the action taken. IN NO EVENT WILL SPONSOR, ITS LICENSEES, AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES, AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE WWW.GONTRAMARCHITECTURE.COM OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THAT SITE. By entering the Pool, participants agree to Sponsor’s use of participant’s personal information as follows: to post results on the web site, for publicity for future contests and to give to companies that co-sponsored the Pool with Sponsor; or to send you information about Sponsor’s products. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Sponsor cannot ensure or warrant the security of any information you transmit to us or any information provided by our on-line products or services, and you do so at your own risk. Sponsor will not be liable for disclosures of your personal information due to errors in transmission or unauthorized acts of third parties. However, once we receive your transmission, we do our best to ensure its security on our systems by making reasonable efforts to protect the information.

WINNERS LIST
The name of the winners may be obtained after the conclusion of the tournament by logging onto www.gontramarchitecture.com.
